The client had been charged with a Colorado state felony involving an allegation of sexual assault on a child by a person in a position of trust. Tom and the firm’s team began building the defense as soon as the case came in.

How the Case Was Dismissed

At the preliminary hearing, Tom’s cross-examinations of the filing detective and the forensic interviewer exposed significant inconsistencies in the evidence against the client. He then filed a series of pre-trial motions challenging the reliability of critical parts of the prosecution’s case. The day after those motions were filed, the prosecutor moved to dismiss, citing an inability to prove the charges beyond a reasonable doubt. The La Plata County District Court granted the motion and subsequently entered an order sealing all records concerning the case.
